By accessing or using MailPulse ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you ("User", "you") and MailPulse ("we", "us", "our").
2. Description of Service
MailPulse provides email deliverability monitoring and analytics for Amazon SES users. The Service includes:
- Real-time email delivery monitoring
- Bounce and complaint tracking
- Alert notifications
- Deliverability reports
- Email verification
- A/B testing capabilities
- Engagement heatmap analytics
- Direct email sending via SES
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. Eligibility
You must be at least 18 years old to use MailPulse. By using the Service, you represent that:
- You are at least 18 years old
- You have the legal capacity to enter into these Terms
- You are not located in a country subject to U.S. sanctions
- You are not on any U.S. government list of prohibited parties
4. Account Registration
To use MailPulse, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
We reserve the right to suspend or terminate accounts that violate these Terms.
5. Acceptable Use
You agree NOT to:
- Use the Service for any illegal purpose
- Send spam or unsolicited bulk email
- Violate any applicable laws or regulations
- Attempt to gain unauthorized access to the Service
- Interfere with or disrupt the Service
- Reverse engineer or decompile any part of the Service
- Use the Service to harm others or their businesses
- Resell or redistribute the Service without written permission
You are responsible for ensuring that your use of MailPulse complies with all applicable laws, including email marketing regulations (CAN-SPAM, GDPR, etc.).
6. Payment and Billing
Free Plan
The Free plan is free forever with limited features and usage. No credit card required.
Paid Plans
Paid plans are billed monthly or annually. By selecting a paid plan:
- You authorize us to charge your payment method
- All fees are non-refundable except as stated in our refund policy
- Prices may change with 30 days' notice
- You can cancel at any time; your plan remains active until the end of the billing period
Refunds
We offer a 14-day money-back guarantee for new paid subscriptions. If you're not satisfied, contact us within 14 days of your first payment for a full refund.
Overdue Payments
If payment fails, we'll retry for 7 days. After that, your account downgrades to Free until payment is resolved.
7. Intellectual Property
MailPulse and its content, features, and functionality are owned by MailPulse and protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal or internal business purposes.
You may not:
- Copy, modify, or distribute the Service
- Use our branding without permission
- Create derivative works based on the Service
- Remove any proprietary notices
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers

- The Service will meet your specific requirements
- The results obtained will be accurate or reliable
- Defects will be corrected
You use the Service at your own risk. We are not responsible for any damages arising from your use of the Service.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAILPULSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or business opportunities
- Damages resulting from your use of the Service
- Damages resulting from any unauthorized access to your data
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Termination
You may terminate your account at any time by:
- Clicking "Delete Account" in your settings
- Contacting us at [email protected]
We may suspend or terminate your account if:
- You violate these Terms
- You fail to pay fees when due
- We are required to do so by law
- We reasonably believe your use poses a security risk
Upon termination, your data will be retained for 30 days, then permanently deleted.
12. Governing Law
These Terms are governed by the laws of the United States, without regard to conflict of law principles.
Any disputes arising from these Terms shall be resolved in the courts of the United States.
13. Changes to Terms
We may modify these Terms from time to time. We will notify you of material changes via email or prominent notice on our website.
Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
